Local business owner back behind bars on Grand Jury indictment

A Rockmart business owner was indicted by the latest Grand Jury sitting for the Tallapoosa Circuit Superior Court as the term came to a close, and now he’s back behind bars and won’t be getting out immediately.

Andrew Earwood – who was arrested in Floyd County earlier this year on similar charges – was indicted by the Grand Jury and a warrant was filed on December 14 for charges of Conversion of Payments for Real Property Improvements. He received a single charge for two separate cases.

He was booked into custody on Tuesday and remains in the Polk County Jail.

Earwood, the owner of the now-shuttered Southern Social in Rockmart and a contractor, will remain in custody without bond set for the time being. The charges will require him to go before a Tallapoosa Circuit Superior Court Judge for a bond hearing before any amount of money is set for his release.

Polk County Police are involved in the investigation into the latest complaints against Earwood.

In at least one of the complaints made against Earwood to Polk County Police, he is accused by the owners of property in the Rockmart-area of taking $140,000 to build a home, but then abruptly cut off contact. He also hadn’t paid subcontractors for their work, per the PCPD report.

According to a previous brief report from the Coosa Valley News, Earwood was booked in August in Floyd County for failing to complete work he was paid $100,000 to finish on Harmony Road, and additionally failed to pay subcontractors.

Earwood was set to sell Southern Social in Rockmart and new owners received permission to take over the establishment in November from the Rockmart City Council for the required special use permit and alcohol pouring license, but the deal fell through and it was shuttered by the city and state fire officials for non-compliance issues.
