Man charged after he left truck partially in roadway unlocked with loaded pistol inside

Rockmart Police arrested a man they found at Waffle House after he pulled his truck partially off the roadway during a DUI incident and left a loaded pistol inside while the car was unlocked, according to reports.

Officers arrested Jacob Lee Spann, 28, of a Cedartown-area address on Sunday morning, February 25 around 3 a.m. after they found him at the Waffle House in Rockmart and told conflicting stories about why he left his truck on the side of Highway 278 at Fairview Road, partially still in the roadway.

Per the report, police found the truck first while another officer was on patrol and believed it to be broken down. Upon searching the inside of the car, police found a loaded Taurus G2C 9mm handgun that was left in the truck while it was unlocked.

The driver was then tracked down to the Waffle House and police went up to the restaurant to find out what was going on and why the truck was left unlocked with a firearm inside.

Police spoke to Spann, who denied driving the vehicle but the driver who got him to Waffle House admitted he had and pulled over at their request. After hearing conflicting stories, police asked Spann if he would blow into a breathalyzer, and it came back to show his blood alcohol level at a .192.

Spann was taken to the Polk County Jail without issue and his blood was drawn for further testing.

The truck was towed after it was left partially in the roadway, and when searched again the firearm was secured and police also found a open bottle of Modelo that was partially drunk behind the driver’s seat.

Spann remained in custody as of this posting on a $4,000 bond on misdemeanor charges of DUI – combination of A1 & A5, reckless conduct, open container violation, improper parking and obstruction of law enforcement officers.
