Police arrest 3 after coming up on suspected drug deal, search house

Polk County Police took three people into custody this past Tuesday evening when officers patrolling the area of Mississippi Street in Cedartown came upon a suspected drug deal in front of a residence, and ultimately found narcotics and marijuana on each suspect in turn, according to reports.

Officers first took Bryan Keith Westmoreland, 54, of 35 Mississippi Drive, Cedartown into custody when they spotted him talking to someone in a car in front of his home who were parked facing the wrong way.

Reports stated the officers were in the area because of suspected drug activity, and when they saw the car and Westmoreland in front of the house found cause to stop and investigate.

When questioned, Westmoreland told officers that syringes found in his pockets were for “Type A Diabetes” after he was searched without having to give consent due to being on probation and having a fourth amendment waiver. Police also found baggies of suspected methamphetamine and marijuana in his pockets as well upon a further search.

He was taken into custody and placed in a squad car.

Police then came up to the vehicle and found Alissa Beth Garrett, 43, behind the wheel and trying to hide a pink pouch underneath her in the driver’s seat while being asked for her identification, which fell to the ground when she was asked to get out of the car. The report stated that she denied it was hers, but officers looked inside and found a baggie just like the ones found on Westmoreland within containing suspected methamphetamine.

A search of the car turned up additional empty baggies, a digital scale and a suspected meth pipe and more than an ounce of marijuana.

Based on this, officers called for a further search warrant into a local judge, who gave consent over the phone and got permission to enter the residence.

James Edward Hendrix, 49, came to open the door for officers and when he saw them tried to throw away a pipe, which police recovered. They also found an additional five people within who were told to leave once Westmoreland was in custody. Hendrix was arrested based on his possession of the pipe, which was found to have suspected methamphetamine residue inside the bowl as well.

Police searched the house and found more unused plastic baggies, another digital scale, multiple used syringes, ledgers, a Pepsi can with suspected methamphetamine on the bottom, and an unidentified white tablet.

The three were taken to jail and the others were allowed to leave the residence. Police towed Garrett’s car as well.

Police reported finding 51 grams of methamphetamine, which is nearly two ounces of the drug, on Westmoreland. An additional seven grams were found on Garrett.

Westmoreland, who officers noted has a history of trafficking in the area and previous charges, was booked on charges of possession of methamphetamine, possession of methamphetamine with intent, trafficking of methamphetamine, two counts of possession of tools for the commission of a crime, and possession of marijuana less than an ounce. Bond was denied for Westmoreland and he remains in the Polk County Jail.

Police also charged Garrett, of 35 Formby Trail, Aragon, with possession of methamphetamine, possession of methamphetamine with intent, two counts of possession of tools for the commission of a crime, felony possession of marijuana and a misdemeanor charge for improper parking. Her bond was set at $23,005.00 and she remained in jail as of this posting on the multiple felony any misdemeanor charges.

Hendrix, of 88 Portland Circle, Aragon, was charged with possession of methamphetamine and possession of tools for the commission of a crime. His bond was set at $6,000 and he was released after spending only a day in custody.
